AN ACT
RELATING TO HAZARDOUS MATERIALS; REQUIRING URANIUM WASTE DISPOSAL IN FEDERALLY MANAGED UNDERGROUND FACILITIES; LIMITING THE ISSUANCE OF PERMITS FOR URANIUM WASTE DISPOSAL TO FEDERALLY MANAGED UNDERGROUND HAZARDOUS WASTE DEPOSITORIES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. [NEW MATERIAL] DISPOSITION OF URANIUM WASTE--PERMITTING OF URANIUM WASTE DISPOSAL.--
A. Uranium tailings and uranium waste from the mining, milling or processing of uranium ore in New Mexico shall only be disposed of in federally managed underground depositories designed for the containment of hazardous waste.
B. No state agency shall issue a permit for the disposal of uranium tailings or uranium waste in a facility other than a federally managed underground depository designed for the containment of hazardous waste.
